We may revise these Terms to reflect new services or legal updates. For significant changes, we’ll notify you at least 30 days in advance via email, text, or our website. Updates take effect when posted or on the notified date. By continuing to use our website or pest control services, you accept the revised Terms. Visit this page regularly to stay updated.
Who Can Use Our Website and Services
Anyone can browse our website, but you must be at least 18 years old to sign up for our pest control services. We don’t collect personal information from users under 13, in compliance with the Children’s Online Privacy Protection Act (COPPA). If you’re a parent or guardian allowing a minor to use our website or interact with our services, you’re responsible for their actions and ensuring they comply with these Terms.
Our Pest Control Services
We provide expert treatments and subscription plans to manage rodents, insects, mosquitoes, and termites, tailored to your needs. Most customers choose monthly billing for flexible schedules—monthly, bimonthly, or quarterly. To ensure effective service, please:
Provide accurate property details.
Allow safe access for our technicians.
Follow written preparation instructions (e.g., via email or service agreement).
Non-compliance may cause delays or extra fees. You must follow all laws related to pest control treatments. We may pause or stop services for non-payment, Terms violations, or external factors like weather or regulations. For disruptions lasting over 30 days, we’ll offer prorated credits or rescheduling; minor delays don’t qualify for refunds.
The Aloha Guarantee
We’re committed to your satisfaction with the Aloha Guarantee. For active subscription customers paying monthly, if covered pests (as listed in your service agreement) return before your next scheduled treatment, we’ll provide a free re-treatment, provided you’ve followed our written preparation instructions. This isn’t a promise of total pest elimination—factors like weather or property conditions may affect results—but a pledge to keep working until you’re satisfied. We’re not liable for:
Pre-existing pest damage.
Harm from your non-compliance with instructions.
Issues from others’ improper pesticide use.
Incidental damages during re-treatments, except for gross negligence.
This guarantee applies only to customers current on their subscription payments.
Payments and Billing
Your service agreement details fees for one-time treatments or subscription plans (e.g., quarterly services billed monthly). Payments are due monthly in advance, with options for monthly, bimonthly, or quarterly schedules. Pay via credit/debit card or other methods through FieldRoutes by calling 813-333-2677 or visiting our website. Late payments incur a late fee of the lesser of $10 or 5% of the overdue amount (up to Florida’s maximum) after 15 days. Regulatory fees may be added with 30 days’ notice, shown separately on your bill.
AutoPay Made Easy
Opt for AutoPay to streamline monthly payments via credit/debit card or bank account, processed through FieldRoutes. It’s optional and convenient. By enrolling, you authorize us to charge your payment method for amounts due on the due date, per U.S. ACH laws. If a payment fails, we may charge a returned payment fee (up to $10 or Florida’s maximum) and retry collection twice within 30 days after notifying you. Update or cancel AutoPay by calling 813-333-2677 at least one day before your next payment. You can stop payments via your bank without breaching these Terms. We comply with the Fair Debt Collection Practices Act (FDCPA) and Florida Consumer Collection Practices Act (FCCPA).
Canceling Your Service
To cancel, contact us at 813-333-2677 or alohapestco@gmail.com. Cancellations take effect within 30 days. Early termination of subscription plans may incur fees per your service agreement. Cancellation ends our obligation for further treatments.
Using Our Website
You’re welcome to use our website for personal, non-commercial purposes like browsing or managing services. Please don’t:
Copy or modify our content (e.g., text, logos) without written consent.
Use bots or data mining tools.
Engage in illegal or disruptive acts (e.g., hacking, spamming).
Violating these rules revokes your website access.
Content You Share
If you post content (e.g., reviews, property photos) on our website, you grant us a non-exclusive, royalty-free, perpetual license to use, display, or modify it to operate, promote, or improve our services. You confirm your content respects others’ rights and that you can grant this license. We may remove or reject content at our discretion.
Text Message Alerts
Sign up for SMS/MMS alerts about services, scheduling, or promotions by opting in (e.g., checking a box on our website or texting a keyword), compliant with the Telephone Consumer Protection Act (TCPA). You must be 18 (or 19 in Alabama/Nebraska). Message and data rates may apply. Reply STOP to opt out instantly. Update your number by calling 813-333-2677 to avoid misdirected texts. We’re not liable for delivery delays or errors.
Your Privacy

No Warranties
Our website and pest control services are provided “as is,” without express or implied warranties, including merchantability or fitness for a particular purpose, to the extent permitted by law. Except for the Aloha Guarantee, we don’t guarantee complete pest elimination due to environmental factors. You use our services at your own risk, and we’re not liable for equipment costs to access our website or pest-related damages.
Limitation of Liability
To the fullest extent allowed by law, Aloha Pest Control LLC and our affiliates are not liable for indirect, special, incidental, punitive, or consequential damages (e.g., lost profits, property damage) related to our website or pest control services, except for gross negligence or willful misconduct. Our total liability is capped at the greater of $1,000 or the amount you paid us for services in the 12 months before a claim. This cap is central to our agreement.
Indemnity
You agree to cover our losses (e.g., claims, costs, legal fees) directly caused by your violation of these Terms (e.g., false property information) or intentional misuse of our services. You’ll assist us in defending such claims.
Resolving Disputes Informally
Have a concern? Let’s resolve it first. Email alohapestco@gmail.com with the issue and your proposed solution. We’ll work together, including a phone call, within 60 days. This step is required before arbitration, and the statute of limitations pauses during this period.
Arbitration Agreement
Disputes about these Terms or our pest control services will be settled by binding arbitrationunder the American Arbitration Association (AAA) Consumer
Arbitration Rules (www.adr.org or 800-778-7879). Start arbitration by emailing a signed letter to alohapestco@gmail.com at least 5 days before filing with the AAA, detailing your claim. Arbitration occurs in Florida, or another agreed location. Opt out within 30 days of agreeing to these Terms by emailing your name, address, and opt-out statement. We both waive jury trials and class actions. Small claims can go to court in Florida. The arbitrator’s decision is final and confidential, unless required by law. If arbitration fees are prohibitive, we’ll cover them as determined by the arbitrator, who may split fees based on claim merit.
Mass Arbitration Process
If 25 or more similar claims are filed against us by the same counsel, a bellwether process applies: each side picks 10 cases for initial arbitration, with others on hold. If unresolved, we’ll mediate with a retired judge, and we’ll pay the mediator’s fee. Claims proceed in batches of 20 or 100 until resolved. The statute of limitations pauses during this process. A court may enforce this.
Governing Law
These Terms are governed by Florida law, without conflict of law rules. Non-arbitrated actions must be filed in Florida state or federal courts.
Other Important Details
We’re not liable for delays due to acts of nature or uncontrollable events. If a Terms provision is invalid, the rest remain. Not enforcing a rule doesn’t waive it. These Terms don’t alter other agreements. We may assign these Terms, but you need our consent. Our third-party contractors are covered by these Terms. Questions?
