These Terms of Service (“Terms”) govern your use of https://aloha-pestcontrol.com, our mobile site, and our pest control services (including mosquito, termite, insect, and rodent treatments).
By using our website or services, you agree to these Terms. If you don’t agree, please do not use our site or services.
This agreement includes an arbitration clause and class action waiver — see section 17.

We provide professional pest control, mosquito, termite, and rodent services with flexible billing options — monthly, bimonthly, or quarterly.
To ensure effective service, you agree to:

Allow technician access to your property
Follow any preparation instructions we provide
Failure to comply may cause delays or additional fees. We may pause service for non-payment, unsafe conditions, or legal restrictions. Extended service interruptions (30+ days) may qualify for prorated credits or rescheduling.
6. The Aloha Guarantee
Our Aloha Guarantee ensures your satisfaction.
If covered pests return before your next scheduled treatment, and you’ve followed preparation guidelines, we’ll provide a free re-treatment.
This guarantee applies only to customers with active, current subscriptions. It does not cover:
Pre-existing pest damage
Neglecting prep instructions
Third-party pesticide use
Weather or property-related issues
We’ll keep working until your home feels pest-free — that’s our promise.
7. Payments and Billing
Your service agreement outlines your selected plan and fees.
Payments are due monthly in advance and may be made by card or bank transfer through FieldRoutes.
Late Fee: $10 or 5% (whichever is less) after 15 days
Regulatory Fee Changes: 30 days’ advance notice will be given
Accepted Payment Methods: Credit/debit card or ACH
8. AutoPay
You may opt into AutoPay for automatic billing.
By enrolling, you authorize Aloha Pest Control to charge your chosen payment method each billing cycle.
If a payment fails, we may apply a returned payment fee (up to $10 or Florida’s legal max) and retry up to twice within 30 days.
You can cancel or update AutoPay by calling 813-333-2677 at least one business day before your next charge.
We comply with the Fair Debt Collection Practices Act (FDCPA) and Florida Consumer Collection Practices Act (FCCPA).
9. Canceling Your Service
To cancel, contact us at alohapestco@gmail.com or 813-333-2677.
Cancellations take effect within 30 days.
Early termination may include fees per your service agreement. Once canceled, no further treatments will be provided.
10. Website Use
You may use our website for lawful, personal purposes such as viewing services or scheduling treatments.
Please do not:
Copy, reproduce, or alter our content without permission
Use bots or data-scraping tools
Engage in hacking, spam, or illegal behavior
We may revoke access for violations.
11. User Content
By submitting reviews, photos, or feedback, you grant Aloha Pest Control a non-exclusive, royalty-free license to use and display that content for marketing or service improvement.
You confirm your content does not violate others’ rights. We reserve the right to remove or edit content at our discretion.
12. Text Message Alerts
By opting in, you agree to receive SMS or MMS updates for scheduling, reminders, and promotions, consistent with the Telephone Consumer Protection Act (TCPA).

We’re not liable for delivery delays or third-party carrier issues.
13. Your Privacy

14. No Warranties
Our website and pest control services are provided “as is”, without implied warranties of merchantability or fitness for a specific purpose.
Except for the Aloha Guarantee, we do not guarantee total pest elimination due to environmental or external factors.
15. Limitation of Liability
To the fullest extent permitted by law, Aloha Pest Control LLC and its affiliates are not liable for indirect, special, or consequential damages (e.g., lost profits or property damage), except in cases of gross negligence.
Our maximum liability is limited to the greater of $1,000 or the total amount paid by you for services in the 12 months before the claim.
16. Indemnification
You agree to defend and indemnify Aloha Pest Control against claims or losses resulting from:
Your violation of these Terms
Providing false property details
Misuse of our services
17. Dispute Resolution & Arbitration
We prefer to resolve issues directly.
Email alohapestco@gmail.com first and allow up to 60 days for informal resolution.
If unresolved, disputes will be settled through binding arbitration under the American Arbitration Association (AAA) Consumer Arbitration Rules.
Arbitration location: Florida (or mutually agreed site)
You may opt out within 30 days of agreeing to these Terms
Both parties waive jury trial and class action rights
Small claims may go to Florida small claims court
If arbitration fees are excessive, Aloha Pest Control will cover or share reasonable costs.
18. Governing Law
These Terms are governed by Florida law, without conflict of law principles.
Any non-arbitrated disputes must be filed in Florida state or federal courts.
19. Other Legal Details
We are not liable for delays caused by natural events or circumstances beyond our control.
If one part of these Terms is found invalid, the rest still apply.
Not enforcing a term doesn’t waive our right to enforce it later.
We may assign these Terms; you may not without our consent.
